ASSUMPTION OF RISK, RELEASE, AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in the activities and attractions provided by Tasty Festivals LLC DBA Carnival Guy Party Rentals (hereinafter "Carnival Guy"),  headquartered in Topeka, Kansas, I, the undersigned, acknowledge and agree to the following terms:

ASSUMPTION OF RISK

I understand that participation in the following attractions: rock wall, dunk tank, inflatable amusement rides, and any other activities or attractions provided by Carnival Guy (collectively, the "Activities"), involves inherent risks of injury or harm, including but not limited to:

• Physical injury from falls, collisions, or equipment malfunctions

• Emotional distress or trauma

• Death

• Damage to personal property

I acknowledge that these risks cannot be eliminated and that they are inherent in the Activities.

RELEASE OF LIABILITY

I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge Carnival Guy, its officers, directors, employees, agents, contractors, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action that I may have for any damage, loss, or injury, including death, that I may suffer or incur as a result of my participation in the Activities.

AGREEMENT NOT TO SUE

I further agree that I will not sue or make any claim against the Released Parties for any damages, losses, or injuries that I may suffer or incur as a result of my participation in the Activities. I understand that this Agreement is a complete bar to any claim or cause of action, and I hereby waive any right to sue or make a claim against the Released Parties.

INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, or causes of action that may arise from my participation in the Activities.

ACKNOWLEDGMENT

I acknowledge that I have carefully read and understood this Assumption of Risk, Release, and Indemnity Agreement (the "Agreement"). I understand that this Agreement is a contract between me and Carnival Guy, and that it shall be binding upon me and my heirs, executors, administrators, and assigns.

ELECTRONIC SIGNATURE

By signing below, I acknowledge that I have read, understand, and agree to be bound by the terms of this Agreement. I understand that this electronic signature shall have the same force and effect as a manual signature.​​​
